Etris Road Developer to Drop Lawsuit if Roswell Approves Proposal

Developers wants Roswell City Council to approve a proposal for 27 homes on Etris Road, Monday, April 8.

After Roswell City Council turned down an Etris Road proposal by Edward Andrews Homes (EAH) for R-3A zoning classification - also known as "multi family residential" - last August, developers sued the city. But now they've offered to drop the lawsuit if council approves changing the existing R-1c zoning to R-1 and R-2 for a 27 lot single family development, with 29 conditions, on Monday, April 8.

Last summer, . Council agreed and instead rezoned the property to an R-1 zoning classification, with the addition of 16 conditions for EAH developers. Developers didn't like the alternate zoning and sued the city. 

But, after talking with surrounding neighborhood leaders, developers offered to dismiss the lawsuit if council approves the R-1 and R-2 compromised zoning proposal on Monday night. Some of the 29 conditions they've promised to self-impose if approved, include:

  • Each home will have a minimum of 2,600 square footage
  • Prior to beginning construction, EAH will prove they have sewer taps
  • EAH will build a "break-away gate" on Kent Road for emergency purposes only
  • There will be a 35-foot buffer between the new neighborhood and Edenwilde subdivision
  • Developers will include a "living fence" at the front and along areas the abut existing homes
  • A "pocket park" will be included within the neighborhood

The proposal was passed onto the council after the Roswell Planning Commission sent it forward without a recommendation in March. Roswell City Council will meet at Roswell City Hall, 38 Hill Street, in council chambers on Monday, April 8 at 7 p.m.
